I agree with your argument about the abandoned games. In fact, I believe Serj was using the Waiting Zone to move the abandoned games without the golden tag.

Due to patreon witch hunt to controversial genre, for this instance is incest. Many dev switch family status to Landlord/Landlady & Tenants. This we all knew already. So what the differences between non-MOD and MOD ?
1- If the vanilla(non-patched) dialog structure like this "You're my tenant, I'm your landlady, we can't have sex". That's a weird sentence right. No country forbid a landlady sleep with their tenant if they're both adult and consensual. So the developer actually making dialog script for incest genre, but Dev create a simple script where word Mom/Mother switch to Landlady. Additional patch reverse the script by forcing the game to switch LandLady back to become Mom/Mother. This considered a non-MOD, but require i-patch.
Script example :
t1 = t1.replace("tenant", "son")
t1 = t1.replace("landlady", "mother")
2- If the vanilla dialog structure never mention that they are blood related, yet the setting felt like family, for example living in the same house, a middle aged woman living with 2 young adult, A modder can recreate the dialog to make it an incest games. This game considered a MOD, because the modder must rewrote the whole sentence.
Script example :
t1 = t1.replace("You're my best friend's son, I felt like betrayed her trust if I slept with you", "You're my son, this is not right")
The first sentence is the original, the second sentence is a recreated dialog.
3- Conclussion = Normal i-Patch file size usually only 1kb due to only have less than 1~20 script lines. MOD i-patch file size usually bigger than 500kb because there's so many normal dialog lines need to be replace/recreate, and getting bigger on each updates as more & more dialogs required to be edited to make i-sense.

They are not blood related to the MC, MC was adopted after his parents died, this is mentioned later in the game, also, until now there has been 0 romance or sexy scenes between the MC and his adoptive mother and at this point I highly doubt that something will happen between them

Considering the future tags and the number of characters, it is possible that there will be M/D as well.

In addition to Benn Swagger explanation. If you see a game here with the tag MOD, it means that it wasn't originally developed to have incest or it has stepcest or the MC is adopted, and a fan made a patch/mod to change the dialogue to have true incest.

Well, I've removed Intertwined for obvious reasons, and I want to know if there's another game that shouldn't be on the list either.
Also, I'm waiting for the next update of Juno's Task to put it on the Waiting Zone (or should we call it Dead Zone!?), since the "unofficial" patch has not been updated for a long time and it seems that jojozz has abandoned incest for good.

Most of the games on the list are like this. Then you'd have a lot of games to take off the list.
After all, part of the essence of the list is games where there is an incest concept. Maybe someone will see a game like this, with adopted crap, and make an incest mod.
I think there should be a spoiler created for games that have the incest concept but no patch yet.
For example In a Scent, dev is definitely using the incest concept to get that audience ( I think incest fetish is pretty popular) but makes it in a lame manner to bypass patreon. Just like so many other games

I agree, Intertwined should not be on the list. Played years ago hoping for family fun times and never got them. A functioning Ipatch for that game would also be quite tricky. Would love to see a working Ipatch for In a Scent, really enjoyed the incest in Personal Trainer and feel like it should be in that game as well.

Intertwined is an interesting one. There is a scene in one earliest updates/episodes when MC could peep on his mother, so I guess probably a lot of people thought this was a hint that incest somehow would be added in one of the further updates, but that didn't happen. It always puzzled me, did Nyx added this just to bait or troll incest fans, or did she just had plan to add it, but ultimately scrapped it?
But on the other hand, she's known for making fun of incest very often, so the first option is could be the case.

About Juno's Task: The walkthrough is updated for Chapter 5 but the patch is not. When someone asked about it, the dev said he would update the patch soon but then deleted the post. It's been a couple of months now. He also made some hard changes in the story that would need a complete rewrite to make incest plausible. But as I said, I'll wait for the next updates to see what will happen.
About Intertwined: The game has no incest whatsoever. It was not designed to have it and neither has a fan-made patch. Many people asked to remove it before but Serj refused it. I removed Maid to Please too for the same reason, (there is also a post from the dev about it). I also removed the M/S tag from Chasing Sunset because it makes no sense. The MC's mother is dead and one of the girls is kind of her clone but it's not her and neither is a full copy of her.
Serj was very lenient in adding anything that could look like incest. In fact, he only created the MOD tag after an argument I made about removing this kind of game. They were tagged as true before. I changed my mind about games with fan-made patches being on the list (even though I personally don't like them) but I won't create a session for games with make-believe incest or that have an incest vibe. I will only add games that either have incest (originally, via an "unofficial" patch or planned) or have a fan-made patch.
About In a Scent: I have no idea what to do with it. I didn't play but I believe it falls in the same category as Fake Father and Young Again. Some characters believe that are committing incest but in fact, they aren't (or vice-versa for the F/D part of Young Again). We could maybe create a tag for it. I'm open to suggestions.
